The website petitcube.com has been developed with the aim of providing a service that meets users' expectations.
Petit Cube is a French company that offers and markets a range of services related to the world of gifts and little touches. The general terms and conditions of sale listed below apply to all of these services. All orders placed on the Petit Cube site are subject to acceptance of the GTC, which are formalised by clicking on the "Pay" button prior to validation of an order.
This implies the client's unreserved acceptance of these general terms and conditions of sale. The present are governed by French law without prejudice to the application of the law of the consumer's country of residence.
Products - shall designate all of the products and services available on the Petit Cube website, such as the personalisation and printing of personalised boxes and the objects contained therein.
The Site - includes all of Petit Cube's online services, their hosted web pages and the products they offer.
The user or client - designates the persons who are co-contractors of the company Petit Cube, who may or may not have registered messages or photos on the site for an order from Petit Cube for themselves or a third party. The user may become a member if he or she wishes to do so by filling out an account opening form.
The recipient - in the event that the user does not order for themselves, the recipient designates the person(s) receiving an item marketed by Petit Cube and ordered by the user for them.
Petit Cube offers a sales services concerning the purchase and personalisation of gifts for the user or a third party named receiver. These services include the personalisation of thick paper boxes with the choice of a decorative design, the inscription of text or the uploading of photos at the user's discretion. In order to use the services of Petit Cube, the user must have an internet connection and have all the necessary equipment, for example a computer and a modem or any other internet connected tool (any connection costs are entirely at the user's or visitor's expense).
Petit Cube may not be held liable for any modification, suspension or interruption of the service and reserves the right at any time, and without notice, to interrupt or modify the service temporarily or permanently.
Under no circumstances do these GT&C confer on the client the status of employee, contractor, agent or representative of Petit Cube. Under no circumstances may these GT&C be considered as a constituent act of any legal person or legal entity whatsoever.
All the products sold by Petit Cube are precisely described . In the event of any doubts about the characteristics of a product, the client can contact Petit Cube via our contact form or our email address hello@petitcube.com.
Petit Cube cannot be held liable in the event of an insubstantial difference between the visuals of the products on the Petit Cube website and the product ordered.
The items contained in and sold with the Petit Cube must be used and consumed in a safe environment. Petit Cube cannot be held responsible for any misuse of the products.
With regard to children's games, we can make the instructions for use and safety recommendations available to the buyer and recipient upon request to hello@petitcube.com.
As far as food is concerned, it must be consumed after being stored in the correct heat and humidity conditions and before the use-by date stated on the product.
Petit Cube undertakes to take all useful precautions with regard to the risks presented by the processing of data, to ensure their security and in particular to prevent them from being distorted, damaged or accessed by unauthorised third parties.
Petit Cube makes every effort to ensure that the site is available 24 hours a day, 7 days a week. However, Petit Cube may not be held liable in the event of its unavailability due to site updates, maintenance, or server unavailability.
For information, the website is hosted by Google Cloud Platform (GCP), Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
All orders placed on the Petit Cube site are payable at the time of ordering. Prices may change at any time depending on the pricing policy. No price changes will apply to orders already placed or in progress.
Registration on Petit Cube is free. The use of the online creation tools and the registering of digital photos on a user account is free.
Prices are indicated in euros, unless explicitly stated otherwise in another currency. The prices applied are those displayed at the time of connection. The prices displayed include French VAT even in the event that tax legislation would render the order not subject to French VAT at the time of payment.
Delivery prices are calculated on the basis of a destination address provided by the client.
In the case of a delivery outside the European Union, the amount of the order as well as the shipping costs paid by the client do not include customs duties and possible taxes to be paid by the client.
The amount of these taxes depends on the country of destination, the client will have to contact the local authorities in order to respect the import costs of goods inherent to his place of receipt of the order.
In the event that the client and/or the recipient of the order is charged customs duties, Petit Cube cannot be held liable for reimbursing these customs duties, which will be borne by the client and/or recipient depending on local customs regulations.
Payments are made online using a secure online payment system. Orders can be paid by credit card, via Paypal or by bank transfer for large orders (over 500 euros).
Petit Cube works with the Sogecommerce bank payment solution, published by Société Générale, which uses the latest and most reliable security systems.
Petit Cube, Sogecommerce and Paypal encrypt the data using the SSL protocol in order to guarantee the security of the data.
The order will be effective after the agreement of the bank payment centre. In the event of the latter's agreement, the account will be immediately debited and the order validated. In case of refusal, the order will be cancelled.
Petit Cube reserves the right to cancel any order due to a payment issue. In the event of a refund you will be credited to the bank account used for payment.
In order to register on the site, the user connects using an identifier associated with a personal password registered at the time of account creation.
Validation of the identifier and password automatically leads to the creation of an account and the opening of a session. The communication e-mail address will be the one provided by the client by default.
The client undertakes to provide accurate and complete delivery and invoicing information that will enable the smooth running of correspondence and the dispatch of the order.
The client undertakes to use their personal account and not to use a third party account without authorisation. The Petit Cube services are strictly for personal use.
Petit Cube products may not be resold by clients or used for commercial purposes.
By creating an account on the Petit Cube site, the client authorises Petit Cube to contact them by e-mail at the e-mail address provided. The client can unsubscribe from the Petit Cube mailing list simply by clicking on the "unsubscribe" option in the Petit Cube emails.
In the event of fraudulent use of their account, the client must alert Petit Cube as soon as possible at hello@petitcube.com.
All users and members acknowledge that they have full rights to the photographs for which printing is requested.
Petit Cube is a personalisation service for gift items and printing and cannot be held responsible for the printed content, which is the responsibility of the user. Users and clients undertake not to infringe the copyright of photographs, or graphic or artistic objects that do not belong to them.
Clients undertake not to use the photos of friends or relatives for personal or commercial purposes without their explicit consent. As Petit Cube is a personalisation service for gift items and printing, the site cannot be held responsible under any circumstances if the content of the photographic work requested infringes copyright or trademark rights.
The client undertakes not to use Petit Cube for racist, paedophilic, pornographic ends or more generally to not infringe the rights of third parties. Petit Cube reserves the right to exclude members who do not comply with the terms and conditions set out here, by disconnecting them or deleting their account and the data inherent to the account.
The information provided at the time of ordering is binding. Petit Cube cannot be held responsible for any incorrect information resulting in the impossibility of fulfilling the delivery of the Petit Cube order. The automatic recording of the data provided by the client is proof of the nature of the order, its date and its price.
The products available on the Petit Cube website may be delivered in metropolitan France or in countries of the European Union at an additional cost specified at the time of ordering. Delivery costs depend on the delivery destination and the type and quantity of products chosen by the client. The delivery period begins once the order has been fully paid for. This period will be specified on the verification page of the client order.
Any anomaly or damage concerning the product (missing product, damaged product) must be indicated upon delivery and as soon as possible (3 days) to Petit Cube via the email address hello@petitcube.com, in accordance with the terms and conditions set out below.
Petit Cube endeavours to meet the expectations of its customers and to offer them good quality services to meet their expectations and those of the people to whom they send a Petit Cube.
If, however, the order does not conform to expectations, the client must make a complaint within 15 days to our client service department (hello@petitcube.com). If the person receiving the Petit Cube is not the client, that person must contact Petit Cube via the intermediary of the client who was billed.
In the event of non conformity with expectations, the following information must be indicated
• Order number
• Surname, first name and billing or delivery address
• Reason for the claim for non-conformity
• Photos proving the non-conformity of the product.
If the non-conformity is proven, the client may obtain a refund for the product, in the form of a promotional code to be used on the site. Petit Cube may decide, in exceptional cases only, to make a refund via the means of payment used when ordering (bank transfer, Paypal, etc.).
The person receiving the Petit Cube may not request a refund in any form whatsoever.
The promotional code or electronic payment refund will be given to the invoiced client and it is for the client and the person receiving the Petit Cube to agree on how to use this refund.
However, by virtue of articles 1641 et seq. of the French Civil Code, all of the products benefit from the legal guarantee against hidden defects that render them unfit for the use for which they are intended, or that so diminish their use that the buyer would not have acquired them or would have paid a lower price for them if he had known about them.
The client expressly acknowledges and accepts that Petit Cube shall perform its contractual obligations. As regards computer services, particularly the operation of the tools and software offered on the site, their proper functioning depends on external factors that are not solely the responsibility of Petit Cube. Petit Cube does not guarantee the quality of its IT services or the violation of user codes of conduct.
Petit Cube does not guarantee the results obtained from the personalisation of its objects, particularly with the use of photographs, which depend on the use of the tools and materials used by the user. The information and advice that may be given by telephone or by e-mail are provided as an aid to the successful use of the service but do not constitute guarantees not expressly provided for in the GT&C.
The client undertakes to guarantee and compensate Petit Cube in the event of a dispute or complaint with a third party relating to the violation of the rights of others or the general terms and conditions set out here.
Petit Cube has been declared to the French public agency CNIL, Commission Nationale de l'Informatique et des Libertés, under the receipt number 2066936.
In addition, it is repeated here that in accordance with French law and the French Data Protection Act n°78-17 of 6 January 1978, you have the right to access, modify, rectify and delete this data, which you can exercise by using our contact form or by post to the address of the company's premises - 5 rue Hancy, 06000 Nice.
Petit Cube reserves the right to contact members using the personal data provided in order to send members offers that are likely to interest them.

It undertakes to compensate Petit Cube against any action by third parties claiming a violation of their rights. The compensation is that which is claimed, together with any legal fees and court costs.
The content made available on the Petit Cube site - files, images and software are the exclusive property of Petit Cube. You may not reproduce, distribute or create derivative work from the Petit Cube site's media without Petit Cube's express consent.
The general terms and conditions of sale are subject to change at any time without notice.
The promotional codes and codes issued in the gift cards are for personal use and sometimes unique. Under no circumstances is it allowed to share or publish any gift card or discount code or to use methods, tools or media that are used by third parties that you are not in a position to think are your personal acquaintances (such as coupon sites, Reddit, Wikipedia).
Petit Cube reserves the right at any time, and without notice, to deactivate or modify a discount code if it is shared publicly. The fraudulently shared code(s) may be modified or deactivated, as well as all orders associated with this code(s), without prior notice.
The personalisation work carried out by Petit Cube on behalf of its customers results in specific photos or photo objects made to the users' specifications and clearly personalised. As provided for in article L.121-20-2, 3° of the French Consumer Code, these products do not give rise to a right of withdrawal.
Petit Cube may under no circumstances be held liable in the event of non-performance or poor performance of the contractual services attributable to the client, including when the order is taken.
The company may not be held liable, or considered to have failed to comply with these conditions, for any delay or non-performance, when the cause of the delay or non-performance is related to a case of force majeure as defined by the jurisprudence of French courts and tribunals.
ALL DISPUTES TO WHICH THE PURCHASE AND SALE OPERATIONS CONCLUDED IN APPLICATION OF THE PRESENT GENERAL CONDITIONS OF SALE COULD GIVE RISE, CONCERNING THEIR VALIDITY, INTERPRETATION, EXECUTION, TERMINATION, CONSEQUENCES AND AFTERMATH AND WHICH COULD NOT BE RESOLVED BETWEEN PETIT CUBE AND THE USER WILL BE SUBMITTED TO THE COMPETENT COURTS UNDER THE CONDITIONS OF COMMON LAW.
